Divorce

Divorce is a big decision, and Arkansas state laws do not take it lightly.  First, Arkansas is a "fault" state, with no irreconcilable differences option. The only no-fault ground for divorce is if the spouses have lived separately for 18 months.  The at-fault grounds for divorce are the following:

  • Impotence
  • Incarceration
  • Adultery
  • Habitual drunkenness for one year
  • Cruel and barbarous treatment
  • Offer such indignities to the person of the other as shall render his/her condition intolerable

To file for divorce, additional residency requirements must be met:

  • Divorce cannot be finalized for at least 30 days after filing
  • Divorce must be filed in the county in which the filer resides
  • Divorce will not be finalized until three months after filing
  • Divorce will take place in county where filer lives

Child custody

In family law cases involving children, both parents begin child custody proceedings on level ground—the mother does not have any legal standing or right to custody beyond the father's.  Based on a number of factors, the judge decides what is in the best interest of the child. Factor may include, but are not limited to:  agent of the child, work schedules, primary caretaker, financial issues, child's activities, etc.

The court tries to ensure that the child has access to both parents, and that the custody share is in the best interests of the child.  However, it is best to have a skilled litigator on your side to make sure that your interests are clear and well-represented in court. 

Child support

Generally, a family court judge uses a standard of child support guidelines to determine the amount of child support the non-custodial parent must pay.  The judge may examine other income factors regarding the needs of the child and ability of noncustodial parent to consistently provide payment.  Many income factors determine the ability to provide:

  • Wages
  • Salaries
  • Commissions
  • Bonuses
  • Workers' compensation
  • Disability
  • Pension/retirement money and interest

Visitation issues

Parents can devise a visitation schedule if they can come to an agreement on visitation.  As with child support, a judge considers the general standard, but the visitation schedule may change it if extraordinary circumstances apply, such as a parent living out-of-state or excessive transportation costs.
